WASHINGTON. o .c . 20009 11-4 -67 Dear Bill, My wallet was stolen out of my purse last night--for the seconi time in 11 weeks to the day--a,i.d in addition to the stolen wallet, your query on the SCWTUS petition for a writ of cerl;iorari is also missing. I have concluded that I must have had it in my purse, and it dropped out, or I left • it at the Supreme Court when I looked at the case on Friday. In any event, I do not have it before me as I am writing -this message to you late Saturday afternoon. You mentioned in your query, as I recall, to wire you what the court did--ie, in taking the case or rejecting it--and send the details airmail. There will be no details. '.Ibe court will give no reason for its action, either way . So I'l~ wire you what the court did. Meanwfiile, ! ' spent most of the day on Friday going over the briefs that have been filed, and I am enclosing the story that I wrote from those notes. Thank God I took complete notes, as I do not have your source material. Everything checks out fine, except the Bureau of Rec. listing on the four projects which are the subject of dispute--namely Rabbit Ear, Troublesome, ~essels and Toponas. The Bureau listing gives the date of their decrees as 1964, in each instance. There is an error somewhere because even the Colorado Supreme Court listed Rabbit Ear and Troublesome as 1959(!nstead of 1950 as the district court had ruled), and Wessels 1961 and Toponas 1963 instead of 1954 and 1951, as the district court had ruled for them individually, respectively. I cannot resolve that discrepancy at this time because everything is closed up tight. Maybe I can on Monday morning. I don't promise it for sure, however, as I had another query that I hoped to get to on Friday, and I took so long on this one that I never got to ICC on the other query. So I may have to get down to ICC early on Monday. I'll see how my work goes. I figured that you could run this story, as is, if you didn't have time to write the whole thing up on Monday because we don't know now when the court orders will come down and how fast Western Union will be. And you could put the court decision in a one-sentence bold face on top of the story . Or if there is time, you can take the one-sentence decision that I'll send you Monday, and run your own story. Okay? It's sure an interesting case. It appeared to me that the Western Slope water districts were raising questions in their briefs which had not been taken up by the State court, so their chances were not too good on this particular petition. But one of these days the whole question of the roles of state and federal governments in water law will have to be defined. The feds apparently didn't think this case was strong enough for them to giv e the water districts support.
